The changing influx of asylum seekers in 2014-2016: Member State responses (Country Report Luxembourg)

Applications for international protection significantly increased in Luxembourg from August 2015 onwards, the total number of applications in fact more than doubling when compared to the previous year (2.447 applicants in 2015; 1.091 in 2014). The number of applications remained high in 2016 (2.035 applications) and 2017 (2.322 applications) albeit slightly decreasing when compared to 2015. These figures are not unprecedented. The number of applications introduced in Luxembourg have fluctuated since 1999, the peaks and declines correlating with specific events. Luxembourg received 2.920 applications for international protection in 1999, an effect of the conflict in Kosovo. Later, the country saw two more peaks in applications after the turn of the century (2003 and 2004 with 1.550 and 1.577 applications respectively, 2011 and 2012 with 2.171 and 2.057 applications respectively). On the other hand, 2005 to 2010 can be characterised as a period of relative calm.The current period of higher arrivals of applicants for international protection is characterised by a change in cultural profile. Previously, most of the time, a majority of people applying for international protection in Luxembourg stemmed from European countries. The influx of applicants in 2015 and 2016 was characterised by the arrival of people stemming from Arabic-speaking countries, populations which had been relatively small in Luxembourg up to that point.While not necessarily unprecedented in magnitude,high numbers of monthly arrivals, especially in the last months of 2015, put those in charge of registering applications as well as of housing and providing social follow-up to the test and led to a number of measures being taken.Generally speaking, fromthe beginning of the increased arrivals in Luxembourg in 2015, the government adopted a relatively open and welcoming position. This position is illustrated for instance in the government’s stance in favour of a solution for the reception of applicants for international protection that is based on European solidarity and the government’s investment in relocation and resettlement.

Upon request by the LIBE committee, this study examines the reasons why the Dublin system of allocation of responsibility for asylum seekers does not work effectively from the viewpoint of Member States or asylum-seekers. It argues that as long as it is based on the use of coercion against asylum seekers, it cannot serve as an effective tool to address existing imbalances in the allocation of responsibilities among Member States. The EU is faced with two substantial challenges: first, how to prevent unsafe journeys and risks to the lives of people seeking international protection in the EU; and secondly, how to organise the distribution of related responsibilities and costs among the Member States. This study addresses these issues with recommendations aimed at resolving current practical, legal and policy problems.

Ortega and Peri – ‘Tightness of immigration reforms over time’

Description
Ortega and Peri focus on the tightness of immigration reforms over time, and they provide quantitative measures of immigration policy restrictions (or tightness) along several dimensions’. By analyzing policy change, Ortega and Peri classify laws based on whether they tighten the requirements of entry or stay in the country, separating laws that concern asylum seekers from laws dealing with other types of immigrants’. The authors analyse policies linked to both ‘asylum’ and ‘non-asylum’. While the authors main interest is on immigrants’ admission, they also include ‘stay’. Ortega and Peri build three separate indices of ‘tightness’ of immigration law reforms. The first index includes only those measures tightening or loosening the entry of non-asylum immigrants, while the second includes measures tightening or relaxing provisions concerning the entry and/or the stay of non-asylum immigrants. The third is an index that includes changes in immigration policy concerning the entry and/or the stay of asylum seekers only.

This study, commissioned by the European Parliament’s Policy Department for Citizens' Rights and Constitutional Affairs at the request of the LIBE Committee, examines the EU’s mechanism of relocation of asylum seekers from Greece and Italy to other Member States. It examines the scheme in the context of the Dublin System, the hotspot approach, and the EU-Turkey Statement, recommending that asylum seekers’ interests, and rights be duly taken into account, as it is only through their full engagement that relocation will be successful. Relocation can become a system that provides flexibility for Member States and local host communities, as well as accommodating the agency and dignity of asylum seekers. This requires greater cooperation from receiving States, and a clearer role for a single EU legal and institutional framework to organise preference matching and rationalise efforts and resources overall.

EACH-FOR: Environmental change and forced migration scenarios

Description
Forced migration is a movement in which an element of coercion exists, including threats to life and livelihood, whether arising from natural or man-made causes (e.g. movements of refugees and internally displaced persons). The changes of natural and man-made environment will probably be the most significant factors among the causes of forced migration. It is essential to get accurate information about the current and future triggers of forced migration in each country of origin and within Europe itself. The two year long project's general objectives are to support European policies, research and the civil society with'forced migration' scenarios, and cooperate with other migration and environment degradation related projects and institutions. The objectives will be achieved by five interlinked research sequences: 1) forecasting the natural and anthropogenic causes of forced migration; 2) analyzing direct (e.g. desertification) and indirect (e.g. conflicts) environmental effects on livelihoods; 3) predicting potential forced migration flows, with emphasis on environmental refugees; 4) contributing to the preparation of statistical indicators to measure environmental refugee flows; 5) dissemination. The study of the causes is a multidisciplinary and multisectoral process. The list of methodological tools contains all traditional elements of research from primary data collection via statistical analysis and environmental evaluation to modelling. The studied cases are selected from the following regions: Europe and Russia, NIS and Central Asia, Asia, Sub-Saharan Africa and Ghana, Middle East and Northern Africa, Latin America. The project will produce detailed sub-region or country level forced migration scenarios, including environmental refugees; presentation of causes leading to forced migration, with focus on environmental concerns; and an online running "environment degradation caused forced migration" model for demonstration and policy purposes.

effective Container inspection at BORDer control points

Description
Efficient NII (non-intrusive inspection) of containerised freight is critical to trade and society. Freight containers are potential means for smuggling (e.g. tobacco), illegal immigration, trafficking of drugs, mis-declared goods and dangerous illicit substances, including explosives, nuclear material, chemical and biological warfare agents and radioactively contaminated goods. One inspection NII technology cannot cope with all these targets. The C-BORD Toolbox and Framework will address all these targets and enable customs to deploy comprehensive cost-effective container NII solutions to potentially protect all EU sea- and land-borders, satisfying a large range of container NII needs. The C-BORD Toolbox will include 5 complementary innovative detection technologies: delivering improved X-rays, Target Neutron Interrogation, Photofission, Sniffing and Passive Detection. User interfaces and data will be integrated to optimise effectiveness and efficiency of end-users and systems. The C-BORD Framework will help customs analyse their needs, design integrated solutions, and optimise the container inspection chain; it will address detection levels, false alarm levels, throughput, health & safety, logistics and cost & benefits. C-BORD will increase the probability of finding illicit or dangerous content with at least equal throughput of containers per time unit, reduce the need for costly, time-consuming and dangerous manual container inspections by customs officials, and in case a container is opened, increase the probability of finding illicit materials. C-BORD involves stakeholders from 8 EU countries, as partners (5) and advisory group members (3). On 3 custom sites integrated solutions will be trialled, respectively addressing the needs of big seaports, small seaports and mobile land-borders. To optimise sustainable impact, C-BORD will actively engage with a large community, will support policy implementation, evolution and start early exploitation planning.
